Terms of Service for Wellsite Pro

1. Acceptance of Terms

By downloading, installing, or using Wellsite Pro ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Wellsite Pro is a mobile application designed to provide drilling engineering calculations and well design tools for petroleum industry professionals. The App provides:

Well geometry and directional calculations
Hydraulics and pressure analysis
Casing and BHA design support
Fluid mechanics calculations
PDF report generation
Multi-language support (English/Spanish)

3. License and Usage Rights

3.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use Wellsite Pro for personal or professional purposes in accordance with these Terms.

3.2 Restrictions

You may NOT:

Reverse engineer, decompile, or disassemble the App
Copy, modify, or create derivative works of the App
Rent, lease, loan, sell, or distribute the App
Remove or alter any copyright, trademark, or proprietary notices
Use the App for any illegal or unauthorized purpose

4. Premium Features and Subscriptions

4.1 Free Trial

Wellsite Pro may offer a limited free trial period with access to all features.

4.2 Premium Subscription

Premium features require a paid subscription
Subscription fees are charged through your app store account (Apple App Store or Google Play)
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Refunds are handled according to app store policies

4.3 Price Changes

We reserve the right to change subscription prices with 30 days notice. Changes will not affect existing active subscriptions until renewal.

5. Calculations Disclaimer

5.1 Professional Reference Only

IMPORTANT: Wellsite Pro provides engineering calculations for REFERENCE PURPOSES ONLY.

All calculations should be independently verified by qualified professionals
The App is a tool to assist, not replace, professional engineering judgment
We make no guarantees about the accuracy or completeness of calculations

5.2 No Liability for Decisions

You acknowledge that:

You are solely responsible for decisions made based on App calculations
We are not liable for any losses, damages, or consequences resulting from use of the App
Professional engineering standards and local regulations take precedence

5.3 Industry Standards

Users are responsible for ensuring compliance with:

API (American Petroleum Institute) standards
Local and international regulations
Company-specific procedures and policies
Safety requirements

6. Intellectual Property

6.1 Ownership

Wellsite Pro and all its content, features, and functionality are owned by Antvar74 and are protected by international copyright, trademark, and other intellectual property laws.

6.2 Your Data

You retain all rights to the well design data you create in the App. We do not claim ownership of your data.

6.3 Feedback

If you provide feedback or suggestions about the App, we may use them without any obligation to you.

7. Privacy

Your use of Wellsite Pro is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

8. Termination

8.1 By You

You may stop using the App at any time by uninstalling it from your device.

8.2 By Us

We reserve the right to:

Suspend or terminate your access to the App for violation of these Terms
Discontinue the App or any features at any time with or without notice

9. Disclaimers

9.1 "AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability

9.2 No Guarantee

We do not guarantee that:

The App will be error-free or uninterrupted
Defects will be corrected
The App is free of viruses or harmful components
Results from using the App will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

10.1 No Liability for Damages

WE SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Lost profits, revenue, data, or use
Business interruption
Personal injury or property damage

10.2 Maximum Liability

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim (or $100 USD if you used the free version).

10.3 Professional Decisions

We are specifically NOT LIABLE for any decisions, losses, or damages resulting from:

Well design decisions based on App calculations
Engineering errors or miscalculations
Equipment failures or operational issues
Safety incidents or accidents

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of third parties
Professional decisions made based on App calculations

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

Posting the new Terms in the App
Updating the "Last Updated" date
Sending an in-app notification

Your continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mexico and the State of Veracruz, without regard to conflict of law principles.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any legal claim, you agree to first contact us to attempt to resolve the dispute informally.

14.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with applicable Mexican commercial arbitration laws.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, along with the Privacy Policy, constitute the entire agreement between you and us regarding the App.
